Modify Child Support and Custody Orders in Dallas and Throughout North Texas

Under certain conditions, individuals may petition the court to modify the conditions of their judgment for child support, spousal support and the terms of their standard possession order (parenting schedule). When the child's health and welfare is in danger, the court may also entertain a petition to reverse the original custody judgment and award conservatorship to the petitioning parent.

The rules for allowing a modification of a judgment are complex and very specific. Generally, the petitioner must show an inability to maintain financial obligations due to a substantial decrease of income or an inability to continue the original parenting schedule because of a change in job status or physical location.

Relocation Petitions

One of the most common reasons for petitioning the court for a modification is because the custodial parent seeks to relocate with the child to another area of the state or country. Under such petitions, the nonconservator parent has the right to petition the court to deny the petition, on the grounds that the relocation would diminish or sever the ties between the child and noncustodial parent. Often, special arrangements can be worked out to change the terms of the standard possession order to ensure the child has meaningful access to both parents.
