Spousal Support And Contractual Alimony

Changes to Texas family law have increased the length of time spousal support may be granted. Except in rare cases, spousal support is granted on a temporary basis. Depending on the length of the marriage and other factors, spousal support may be granted for up to five, seven or 10 years.

The person receiving support must lack the assets to provide for his or her minimum reasonable needs. He or she must also meet certain criteria such as an inability to earn sufficient income because of an incapacitating mental or physical condition. Contractual alimony is an option in some divorces, especially in high-asset divorces. While spousal support is court-ordered, contractual alimony is not. It is an agreement between the parties. Contractual alimony can be good for equalizing the property division settlement by compensating one spouse for his or her share of an asset.
