What Types of Orders May Be Modified?
Depending on the facts and the governing order, Texas courts may consider changes to conservatorship, possession and access, child support, medical support, and certain spousal-maintenance obligations. The property division in a final divorce decree is generally not reopened, although courts may clarify or enforce its terms.
Material and Substantial Changes
A modification usually requires proof of a qualifying change in circumstances. Examples may include a significant income change, relocation, a new work schedule, health concerns, a child’s changing educational or medical needs, or facts affecting a child’s safety and stability. A change is not automatically enough; the requested order must satisfy the applicable legal standard.
Modification Is Different From Enforcement
If the existing order still works but the other party is not following it, enforcement may be the correct path. Filing a modification does not suspend the current order, and private agreements do not replace it. Continue following the signed order unless the court enters a new one.
