Do not reduce, redirect, or stop court-ordered support based only on an informal agreement. Seek a formal modification when circumstances change.
Do not make unilateral changes. A job loss, direct-payment arrangement, change in parenting time, or disagreement about access does not by itself rewrite the signed support order.
How Should Support Be Paid and Documented?
Many Texas orders use income withholding and the state disbursement system. When a payment is made outside the ordered channel, the payer should preserve receipts, bank records, communications, and a clear description of what the payment covered. A gift or household purchase may not automatically receive credit as child support, and incomplete records can create a dispute about the official balance.
What Can Happen After Missed or Inconsistent Payments?
Past-due support can lead to enforcement proceedings and remedies that may include income withholding, confirmation of arrears, a cumulative money judgment with statutory interest, liens, license consequences, and contempt when the legal requirements are met. Unemployment or financial hardship should be addressed promptly; it does not automatically suspend the order.
What Happens at an Enforcement Hearing?
The moving party must identify the alleged violations, and the respondent has the right to notice and an opportunity to present evidence and applicable defenses. Because contempt can carry serious consequences, procedural requirements matter. Ignoring a properly issued notice or order to appear can create additional problems, including issuance of a capias in appropriate circumstances.
Can Support Be Changed or Past-Due Amounts Reduced?
A material and substantial change or another statutory basis may support modification, but a request should be filed promptly. Modification is generally prospective under Texas law and does not simply erase support that became due before the permitted effective date. Confirmed arrears can remain enforceable after current support ends.
Are Child Support and Visitation Linked?
The duties to pay support and comply with possession or access orders are generally enforced separately. A parent should not withhold support because access was denied, and another parent should not deny court-ordered access because support is unpaid. Each violation should be addressed through the appropriate legal remedy.
