The account balance is only the starting point. Characterization, vesting, taxes, liquidity, loans, survivor rights, and the transfer mechanism can materially change what a retirement award is worth.

Community and Separate Retirement Interests

Texas generally presumes property possessed during divorce is community property, while a spouse claiming separate property must prove that character by clear and convincing evidence. Retirement benefits attributable to service or contributions during the marriage may have a community component. Benefits earned before marriage or after the marital estate ends may remain separate, but plan records and tracing are essential.

Identify Every Benefit and Its Rules

A complete inventory may include defined-benefit pensions, 401(k) and 403(b) accounts, profit-sharing plans, deferred compensation, IRAs, employee stock plans, government benefits, and military retirement. Current statements do not always reveal every feature. Plan descriptions, employment histories, vesting rules, beneficiary designations, loans, and survivor options may also matter.

QDROs—and When Another Method Applies

Many private employer plans governed by federal law are divided through a qualified domestic relations order, or QDRO. IRAs generally use a transfer incident to divorce rather than a QDRO, while government and military plans may require different orders and agency-specific language. The plan administrator or appropriate agency should review the proposed mechanism before the case is treated as complete.

Compare After-Tax Value, Risk, and Liquidity

Trading retirement assets for a house or another asset can be reasonable, but equal headline values are not necessarily economically equal. A traditional retirement account may carry future income tax, a Roth account may differ, a pension may depend on future payments and survivor elections, and real estate carries expenses and market risk. Valuation should consider timing, taxes, liquidity, and the assumptions behind each number.

  • Outstanding plan loans, vesting, and future employer contributions
  • Survivor benefits and what happens if a participant dies or retires early
  • Tax treatment, rollover options, and responsibility for fees
